Welcome to the Montefiore Pizza website (hereinafter: "the Site").

The Site is operated by Montefiore Pizza (hereinafter: "the Restaurant" or "the Business") and allows ordering food products via the internet.

Use of the Site, including placing an order, constitutes confirmation by the user that they have read, understood, and agreed to the terms of these regulations. If you do not agree to the terms, please do not use the Site.

1. Use of the Site and Ordering

  • Prices on the Site are displayed in New Israeli Shekels (NIS) and include VAT as required by law.
  • Images on the Site are for illustration purposes only. There may be slight differences between the images and the actual products supplied.
  • Placing an order on the Site is permitted for users aged 18 and older, who are legally competent to perform binding actions and hold a valid payment method.
  • The customer must provide full and accurate details when placing the order, including name, address, phone number, and additional contact details as required.
  • Providing incorrect or partial details may cause delays or non-delivery of the order, and the responsibility for this will fall on the customer.
  • The site commits not to publish or encourage any illegal content of any kind, including gambling sites, pornographic content, or any other illegal activity.

2. Order Confirmation

  • Sending the order does not constitute final confirmation for its execution.
  • The order will be considered confirmed only after it has been received in the system and approved by the restaurant.
  • In exceptional cases, such as product shortage, technical failure, pricing error, or any other circumstance that prevents the execution of the order, the restaurant may contact the customer to change or cancel the order. In case of cancellation after payment, a refund will be issued according to the law.

3. Products and Prices

  • The restaurant may update the variety of products, prices, promotions, and menus displayed on the site from time to time, without prior notice.
  • In the event of an error in price, product description, image, or availability, the restaurant will be entitled to correct the error or cancel the order, while updating the customer and refunding any amount paid.

4. Deliveries and Distribution Areas

  • Delivery service is provided within the restaurant's delivery areas only.
  • As of the publication of these terms, delivery service is provided within the city of Be'er Sheva only, unless otherwise stated on the site.
  • Delivery fees, minimum order amounts, and delivery times will be displayed during the ordering process, before payment is completed.
  • Delivery times displayed on the site are estimated only, and there may be changes or delays due to workloads, weather conditions, traffic, exceptional events, or other circumstances beyond the restaurant's control.
  • The restaurant makes every effort to deliver the order on time, but does not guarantee an exact delivery time.

5. Payment

  • Payment on the site is made using the approved payment methods displayed on the site.
  • The business may add or remove payment methods from time to time.
  • Execution of the order is subject to the approval of the credit card company or payment service provider.

6. Privacy and Information Security

  • The restaurant respects the privacy of its customers and works to protect the information provided during the use of the site.
  • Personal details provided when placing the order will be used to process the order, deliver it, contact the customer, and provide service.
  • The site uses acceptable and reasonable information security measures to protect the information.
  • Credit card details are not saved in the restaurant's systems. Payment is processed through an external and secure clearing provider, in accordance with acceptable procedures and standards.

7. Kashrut

The restaurant operates under the kosher supervision of the Eda Haredit and Harav Landa.

8. Cancellation Policy

The cancellation policy is subject to the provisions of the Consumer Protection Law, 1981.

Since these are food products prepared specifically for each order and are considered perishable goods, special rules apply to the cancellation of transactions.

9. Intellectual Property

All intellectual property rights on the site, including the design, logo, trademarks, images, menus, texts, graphics, and any other content, belong to the restaurant or to the rightsholders who permitted their use.

Do not copy, reproduce, distribute, publish, publicly display, or make any commercial use of the site's content without prior written permission from the restaurant.

10. Limitation of Liability

  • The restaurant makes efforts to ensure that the information on the site is correct, updated, and accurate, however, errors or inaccuracies may occur.
  • The restaurant will not be liable for damages caused due to circumstances beyond its control, including communication failures, internet outages, power outages, force majeure, authority instructions, or other exceptional events.
  • Nothing in the above derogates from any liability imposed on the restaurant under the law.

11. Modification of Terms

The restaurant may update the provisions of these terms from time to time, at its discretion. The updated version published on the site will be the binding version from the date of its publication.

12. Governing Law and Jurisdiction

These terms and the use of the site will be governed solely by the laws of the State of Israel.

The local jurisdiction in any dispute regarding the use of the site or orders placed through it will be vested in the competent courts in the Southern District, subject to the provisions of any law.
